Welcome to Capstra (“we,” “our,” or “us”). By accessing or using our 3D imaging platform (the “Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. Account Registration
- You must create an account to access certain features.
- You agree to provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. User Content
- You retain ownership of any 3D models, images, or other content you upload (“User Content”).
- By uploading User Content, you grant Capstra a worldwide, royalty-free, sub-licensable license to use, display, and distribute your content in connection with the Service.
- You agree not to upload content that is illegal, infringing, harmful, or violates others' rights.
4. Acceptable Use
You agree not to:
- Use the Service for illegal purposes.
- Harass, abuse, or harm others.
- Attempt to reverse-engineer, interfere with, or disrupt the Service.
- Upload viruses, malware, or other harmful code.
5. Privacy
Our Privacy Policy governs how we collect, use, and protect your information. By using the Service, you consent to the practices described in our Privacy Policy.
6. Intellectual Property
- All platform features, software, and content not provided by users are the property of Capstra and protected by copyright, trademark, and other laws.
- You retain ownership of any content you upload (“User Content”). However, by uploading User Content, you grant Capstra a worldwide, royalty-free, sub-licensable and perpetual license to use, reproduce, modify, distribute, display, and create derivative works of your content for any purpose, including but not limited to:
- Improving, training, or developing AI models or other machine learning systems
- Marketing, promoting, or otherwise operating the Service
- Displaying, sharing, or sublicensing your content on or through third-party services
- You agree that this license is irrevocable and that we may exercise these rights without further notice or compensation to you.
- You may not use our intellectual property without prior written permission.
7. Termination
- We may suspend or terminate your account at any time for violation of these Terms.
- Upon termination, your access to the Service will end, but provisions regarding intellectual property, liability, and other ongoing obligations will survive.
8. Disclaimers
- The Service is provided “as is” and “as available.”
- We do not guarantee that the Service will be uninterrupted, secure, or error-free.
- You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, Capstra shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.
10. Governing Law
These Terms are governed by the laws of United Kingdom, without regard to its conflict of law principles. Any disputes will be resolved in the courts of United Kingdom.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes, and continued use of the Service constitutes acceptance of the updated Terms.
